These terms and conditions form the basis of CBN Media Pty Ltd's ("CBN") Club Shack and govern the use of Club Shack membership. Information on how to register, the Registration and Terms and Conditions for Participation form part of these terms and conditions.

1. Club Shack membership
   1. Participants who wish to apply for Club Shack membership must register online at www.CyberShack.com and in doing so they agree to be bound by these terms and conditions.
   2. Membership is open only to Australian and New Zealand residents (15 years and above)
   3. CBN may reject or refuse any Registration at its discretion.
   4. A participant may terminate or cancel their Club Shack membership at any time by going to www.CyberShack.com and going to My Login to update their details.
   5. Club Shack is a free membership club which offers competitions, and access to the Members page, to participants who register their details online at www.CyberShack.com
2. Prizes and offers through Club Shack
   1. Club Shack will offer from time to time, prizes for competitions run online
   2. CBN has the right to amend/change the stated prize given to a prize winner at its discretion as long as the value of the prize remains the same or as close to the stated prize as possible
   3. Prizes will be mailed out to a prize winner up to 8 weeks from when CBN receives prize winner's mailing address details
   4. CBN is not held responsible for any prize that is lost/stolen/misdirected while in transit via mail
   5. CBN is not liable to provide a replacement prize should the package not arrive in its original condition or does not arrive at its final destination
   6. There is no exchange of prizes or money transferable option available instead of a stated prize
   7. Should a member reside outside of Australia or New Zealand that member will not be valid to win any Club Shack competition
3. Variation or change to Terms and Conditions
   1. CBN reserve the right to vary the terms and conditions of Club Shack membership, or suspend or terminate the Promotion at any time without prior notice.
   2. CBN may at any time in its absolute discretion and without notice, cancel Club Shack, or make any other change to membership benefits or privileges.
   3. CBN will endeavour to advise members of information about Promotions (such as any changes of the kind listed above), but CBN will not be liable for any failure to do so.
4. Notice
   1. Any notice to a member will be posted to the member at the mail or email address appearing on CBN.s file records. It is up to the Club Shack member to ensure that their details remain current through the use of My Login listed on www.CyberShack.com. Notices to CBN shall be posted to PO Box 289, ST LEONARDS, NSW, 1590, or to contact@cybershack.com
5. Limitation of Liability
   1. All conditions and warranties whether express or implied and whether arising under statute or otherwise; as to the condition, suitability, quality, fitness or safety of any goods or services supplied under any Promotion are expressly excluded to the full extent permitted by law. Any liability CBN may have to a Club Shack member in respect of such goods or services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again.
   2. If any Promotion such as guest forum interviewees, game downloads or other such item is not able to be made available online as stated then CBN have the right to replace or amend said item/person solely at their discretion.
6. Privacy Policy
   1. CBN respects your rights to privacy under the Privacy Act 1988 and is required to comply with the national privacy principles in respect of the collection of personal information from individuals.
   2. The personal information collected under the Club Shack Program includes your name, address; birth date and email address which is required to enable us to properly conduct the Club promotion including the award of competition prizes. It is optional for you to provide us with any additional personal information contained in the Registration.
   3. You will be eligible to receive Club Shack direct marketing material either by email or text message. If you indicate on the Registration form, or at any time thereafter, that you do not wish to receive this, it will not be sent to you.
   4. We will not disclose personal information collected about you to any other party outside of CBN Media Pty Limited.
7. Resolution of Disputes
   1. Any question or dispute regarding any Promotion or in connection with members. participation in the Promotion or Club Shack in general will be resolved by CBN in its sole discretion.
8. General
   1. In these terms and conditions: "CBN" means CBN Media Pty Limited ACN 93 084 044 584 or its authorised representatives.
   2. Employees and their immediate families, of CBN Media, Chic Media or its agents, contractors or suppliers, are ineligible to take part in the Promotion or apply for a Club Shack membership.
   3. The promoter is CBN Media Pty Limited ACN 93 084 044 584 of Level 3, 621 Pacific Highway, St Leonards, NSW, 2065. Permit Numbers will be issued for each promotion where necessary.
